Prices, delivery and payment terms
All prices are given in Euro (€) and exclude the valid legal value added tax. Subject to price errors and changes. For deliveries from a net order value of € 150, delivery of goods within Germany and Austria is free of charge, to South Tyrol from a net order value of € 350. Deliveries to Switzerland are free of customs duties from a net order value of € 350 and free of customs duties and shipping costs from a net order value of € 550. If the order value is below these limits, the actual shipping costs will be charged.

The risk shall pass on to the Buyer as soon as the product to be shipped have been handed over to the carrier or has left the Seller’s works for the purpose of shipment. Upon the buyer’s request, deliveries will be insured in his name and for his account. For payment by direct debit (for DE and AT) 3% discount, within 8 days from date of invoice 2% discount or within 30 days net, for South Tyrol and Switzerland within 30 days net. Bank charges for return debit notes in the event of objection or inability to pay shall be borne by the purchaser. Natural disasters, bad harvests, changes in the world market are not predictable – therefore the prices for oils and herbs are subject to change.

 

Orders
Orders can be placed by telephone by fax or e-mail. They are binding. Only our delivery and payment terms shall apply. A written order confirmation shall only be issued upon express request of the purchaser. The buyer is responsible for the legality and correctness of the order. There will be no verification on our part.

 

Inspection of incoming goods

The goods must be checked for breakage, damage and completeness in the presence of the carrier before signing the delivery documents, i.e. before acceptance by you. For insurance reasons, later complaints cannot be taken into account. With your signature you confirm to have received the entire goods undamaged.

 

Exchange and return

In principle, exchanges and returns shall only be possible with prior written agreement. We reserve the right to send back returns which have been sent in without our consent. We reserve the right to charge a handling fee for the processing of returns (depending on the effort involved).

 

Retention of title

Delivery shall be made under unrestricted retention of title. This shall also apply in the event of resale by the purchaser until payment has been made in full.

 

Applicable law, court of jurisdiction, partial invalidity

(1) The law of the Federal Republic of Germany shall apply to these Terms and Conditions and the entire legal relationship between the Seller and the Buyer with a registered office in Germany or abroad; for Buyers with a registered office in Austria, the law of the Republic of Austria shall apply.

(2) Insofar as the purchaser is a registered trader within the meaning of the German Commercial Code, a legal entity under public law or a special fund under public law, Traunstein for Germany and Salzburg for Austria shall be the exclusive place of jurisdiction for all disputes arising directly or indirectly from the contractual relationship.

(3) Should one or more provisions included in these terms and conditions or a provision within the scope of other agreements be or become invalid, this shall not affect the validity of all other provisions or agreements.

Final clause

Should parts or sections of these terms and conditions become ineffective due to changes in the law of obligations or other legal provisions, the corresponding legally effective regulation according to the German Commercial Code that comes closest to the actual meaning and economic purpose of the part or section shall take effect. The same applies in the event of a gap in the conditions.
